Theres alot of hype around her lately, if people don't know about her, she assisted with killing 2 girls and her sister, well didnt really assist, more stand by and watch in a way. Not too serious of a topic I hope.... :D

Ummm, we're in Canada DigitalLava no death penelty. What she did definately deserved more time than she recieved, and don't think the media should leave her alone. The courts gave her a sentence, now lets let the public give her the one she deserved.

not since the 60's, and I really doubt most Americans would know about her. I mean I was only like 5 or 6 when it happened.

Yeah, Nemmie's right. How could she get the Death Penalty when Canada abolished it in the 60s? Anyways, even if we still had it, I don't think her roles in those slayings of the school girls warranted a death sentence for her. For Paul Bernardo yes, but that's not what you asked :D I think Karla's sentence is tough enough, and I do agree that the Media shouldn't leave her alone. The public has a right to know where she is. She's the most hated woman in Canada, and she's already received countless death threats from the public.. even those she may be free from prision, I don't think she'll ever be truly "Free".

 

This is mainly a Canadian topic, and I doubt most Americans would know who she is, so here's a timeline of events that lead to her arrest.. remember, in Canada, we're not really used to heinous crimes like this..

Uh, yeah. If they were American, I would vote definately that HE lose his life. She should never see the light of day again. If she was still a danger to society in 2002 and 2003, when she was denied parole, then she is certainly still as much 2 and 3 years later.

shoot em both..end of story ...i was about 14 when it happend, and I remeber the local police coming around to inspect every white camero from ottawa to windsor, i remember watching them take 2 hours to literally comb through every inch of my fathers car, i remember watching the family making broken-hearted news statements after bernardo and hamolka were caught and the outrage and disappointment after the sentences were laid down, the canadian justice system is a farce, not due to the lack of will by the judges, but due to a whimsical, lacklustre and completely useless government who refuses to get hard on crime..If I had my way, they would both be tied to stakes in the middle of Toronto and executed, having the execution broadcast on CBC coast to coast as a clear example of what happens to sick little *&^$^& like them. whew....did'nt mean for this to turn into a rant....oh well......wait..who has cheese? mmmmm......cheese

And now...for my Legal analysis.

 

If this were in a US State with Capitol Punishment:

 

Karla would not face Murder 1 with Special Circumstances (Death Penalty); she might however get Murder 1 25-Life or Murder 2 depending on whether the crimes were pre-meditated or not, because from what I can see she was not the central figure of the main bulk of charges, however given the amount of evidence against her, the case would likely not go to trial and she'd plea out to lesser charges. (Given I think that 12 years isn't enough.)

 

Also, if this were in America...all of that information that was used in the actual trial would be completely public and up for grabs as she is "liable" proof, meaning that she can not be liabled. Under US standards she also has no reasonable right to privacy, given her prior transgressions.

 

This would also not stand water in a US Court:

June 3, 2005:

After two days of arguments, Judge Jean R. Beaulieu agrees that Karla Homolka may pose a risk to society after she is released. He places several restrictions on her freedom that are to take effect after she is released. They include:

She is to tell police her home address, work address and who she lives with.

She has to notify police as soon as any of the above changes.

She will also have to notify police of any change to her name.

If she wants to be away from her home for more than 48 hours, she will have to give 72 hours notice.

She cannot contact Paul Bernardo, the families of Leslie Mahaffy and Kristen French or Jane Doe. She also may not contact any violent criminals.

She also will be forbidden from being with people under the age of 16 and from consuming drugs other than prescription medicine.

Continue therapy and counselling.

Provide police with a DNA sample.

 

Her husband, Paul Bernardo would likely get nailed on Murder 1 with Special Circumstances because the acts appear premediated and were wanton and particularly hienous.
