Oh. My. God.

Ok, I don't realy know where to start, since I'm still highly ammused by this, and it's hard to concentrate...

 

Anyways, I'm going through all my message boards...and I find this...

 

Illegal Drug Tax

 

Just....wow.

 

It says that about ten other states do it also. I'd like to know what they are, if you happen to live in a state where you have to get a drug stamp for you marry jane....

Either this is fake or Kansas has some really dumb politicians. Why not just boost the fine of possessing drugs?

 

I wonder if drug dealers are handing out W2s now.

OK, I have 4 comments:

 

1) I suspect not very much tax revenue is raised by this. It would require someone breaking the law to willingly walk into their state's tax office and identify themselves as a lawbreaker.

 

2) The right against self incrimination, which compliance with this tax law is a necessary condition of in this state, is protected by the US Constitution. This state law restricts that right and is, therefore, unconstitutional.

 

3) I'm not advocating this position here but, if the issue really is about raising taxes, it would be more effective to simply legalise it and collect taxes on the drug sales openly.

 

4) Although this specific plan is unworkable, for the reasons listed above, the *principle* of collecting tax revenues from illegal activities is sound. Al Capone's first trial was not for murder or trafficing or extortion or racketeering. It was for income tax evasion, for not paying taxes on the above activities. Once he was safely in prison on the income tax charge witnesses for the other activities came forward and it was only then that he could be convicted of the other stuff.

Vex,

I actually heard about this a few months ago, and all you have to do it "pay the tax" on the drug in question. No I.D's, but you get a reciept. Then if you are caught with the drug in question, you are off scott free from the I.R.S.
