To: Lieutenant Commander Ethan Hawke, Security Chief - S.K. Aegis

 

Subj: Appointment

 

Lieutenant Commander Hawke;

 

On Stardate 0302.04, Starfleet Chief Judge Advocate General Rear Admiral Josylin S. Jones announced the appointment of Captain Frederic Meve and Commander Nicholas Ayers, holding a rank higher than that of Lieutenant Commander, to the positions of members of the Special Courts-Martial Convening Authority (SPCMCA) for the Cardassia Sector. To this end, the following is hereby ordered:

 

Effective this date, you are hereby appointed as Chief Investigating Officer (IO) over matter(s) pertaining to behavior reported to have taken place against Zog Gabrel, Chief Science Officer of Sky Harbor Aegis on Stardate 0308.01.

 

In accordance with Section 816, Article 16 of the Starfleet Code of Justice, should your investigation determine probable cause, you are authorized to request the convening of a courts martial. Per Paragraph 3A and 3B, should this situation develop, the convening authority will meet for either a special courts-martial, if three flag officers can be located, or summary courts-martial, consisting of one commissioned flag officer.

 

You are authorized to utilize any resource you feel necessary to meet the below stated goals. Should you see reason to do so, the appointment of a special prosecutor to represent the facts as you have discovered them and to confirm request of convening is authorized. Note that requirements of Section 824 and Section 826, displayed at the end of this padd, are in effect.

 

The persons you designate to participate in this investigation are charged with the following objectives:

 

      - Behavior in violation of Starfleet regulations, in accordance with stated behavior which is to be expected of all personnel having once completed the taking of their said oath before official command representatives.

 

      - Violation of code of conduct under terms of treaty between the United Federation of Planets and Dominion and Cardassian Union and Breen Confederation, Article 10. Specific to dealings with "defense assistance agreement of all former territories represented by or controlled by forces of the Dominion and Cardassian Union..."

 

      - Purposefully impeding work of a ranking individual during a potentially mission critical situation.

 

      - Sabotage of Federation property and that of it's Allies.

 

      - Disobeying a direct order from a superior officer.

 

STARFLEET CODE OF JUSTICE:

Section 824, Article 25, Statue B

"When only one, or less than three commissioned officer(s) is(are) present with a command or detachment (s)he shall be the summary court-martial of that command or detachment and shall hear and determine all summary court-martial cases brought before him/her.  Summary courts-martial may, however, be convened in any case by superior competent authority when considered desirable by him."

 

Section 826, Article 26, Paragraph D

"No person is eligible to act as a member of a panel in a case if (s)he is the accuser or client called for the prosecution or has acted as investigating officer or a counsel in the same case."
